Acceptance of Terms

By accessing and using Art Gallery ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Description of Service

Art Gallery provides access to high-quality digital art collections from renowned artists throughout history. Our platform allows users to browse, search, and download artwork for personal and commercial use, subject to the licensing terms specified for each artwork.

Service Availability Disclaimer: Content availability, image resolutions, file formats, and download options are subject to change and may vary by artwork. High-resolution files are provided where available and technically feasible. We make no guarantees regarding specific resolution levels, file sizes, or format availability.

Account Registration

• You must provide accurate and complete information during registration
• Email verification is required to activate your account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person or legal entity per account

User Conduct

You agree not to:

• Use the service for any unlawful purposes or activities
• Share your account credentials with others
• Attempt to gain unauthorized access to our systems
• Use automated tools to scrape or download content in bulk
• Resell or redistribute downloaded content without proper licensing
• Reverse engineer or attempt to extract source code from our platform
• Upload malicious code or attempt to harm our infrastructure

Content and Licensing

Artwork Licensing

• Most artworks in our collection are in the public domain
• Some contemporary works may have specific usage restrictions
• Commercial use is generally permitted but may require attribution
• Licensing terms are specified on each artwork's detail page
• You are responsible for ensuring compliance with applicable copyright laws

Platform Content

All text, graphics, user interfaces, and software on our platform are owned by Art Gallery and are protected by copyright and other intellectual property laws.

Payment and Subscriptions

Billing

• Payments are processed securely through Stripe
• All fees are non-refundable unless explicitly required by applicable law
• Subscription fees are charged in advance on a recurring basis
• We reserve the right to change prices with 30 days written notice
• Failed payments may result in immediate service suspension
• Disputed charges must be reported within 30 days of billing
• Currency conversion fees and payment processing fees are your responsibility

Subscription Points

• Subscription points are added to your account monthly based on your plan
• Unused points accumulate and do not expire during active subscription
• Points are non-refundable and have no cash value under any circumstances
• Upon subscription cancellation, unused points remain permanently non-refundable
• Point values and costs are subject to change with notice
• We reserve the right to modify the point system structure and requirements
• Points cannot be transferred, sold, or exchanged outside our platform

Trial Points

• New verified accounts receive 5 free trial points
• Trial points expire after 12 months of inactivity
• Points cannot be transferred between accounts

Download Policy

• Downloads are for the account holder's use only
• Downloaded files should not be shared publicly without proper licensing
• We provide artwork in multiple resolutions and formats where available and technically feasible
• Resolution levels, file sizes, and formats may vary significantly between artworks
• Ultra high-resolution files (up to 10K+ pixels) are available where source material permits
• Download links expire after 24 hours for security purposes
• We maintain download history for your convenience
• File quality and specifications are provided "as is" without warranty

Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices. We implement industry-standard security measures and require email verification for account security.

Content Quality and Technical Specifications

Image Quality Disclaimer

• No warranties on resolution: While we advertise high-resolution files up to 10K+ pixels, actual resolution depends on source material quality and availability
• Variable file specifications: File sizes, formats, color profiles, and compression levels vary significantly between artworks
• Source limitations: Digital artwork quality is limited by original documentation, scanning equipment, and historical preservation conditions
• Processing variations: Color correction, upscaling, and digital enhancement may introduce artifacts or variations from original artworks
• Format compatibility: File formats (TIFF, JPEG, PNG) are selected based on technical considerations and may not always be available in your preferred format

Accuracy and Attribution

• Artwork titles, dates, and attributions are provided for reference and may contain historical inaccuracies
• We make reasonable efforts to ensure accuracy but do not guarantee the completeness or correctness of metadata
• Users are responsible for independent verification of artwork information for scholarly or commercial purposes
• Color accuracy may vary due to monitor calibration, file compression, and digital reproduction limitations

Service Availability

• We strive to maintain high uptime but make no guarantees regarding service availability
• Scheduled maintenance will be announced in advance when possible, but emergency maintenance may occur without notice
• We may temporarily suspend service for security, maintenance, or operational purposes at our sole discretion
• Force majeure events, including but not limited to natural disasters, cyber attacks, or infrastructure failures may affect service availability
• Third-party service dependencies (payment processors, CDNs, hosting providers) may cause service interruptions beyond our control
• No compensation or refunds will be provided for service downtime or interruptions
• Download links and service access may be affected by high demand or system load

Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will stop immediately.

Disclaimers and Limitation of Liability

Service "As Is" Disclaimer

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We make no representations or warranties regarding the accuracy, completeness, reliability, or availability of the Service or its content.

No Warranty on Content Quality

• We provide no warranty regarding image resolution, file size, or format specifications
• Artwork quality and technical specifications may vary and are subject to source material limitations
• High-resolution claims are approximate and based on available source materials
• Color accuracy, compression artifacts, and file integrity are provided without warranty
• Download speeds and availability may be affected by external factors beyond our control

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is less.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is incorporated, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
